Thank you for choosing our platform. These Terms of Service ("Terms") govern your use of our image-generation and enhancement platform (the "Services") provided by Tuari AI UG (haftungsbeschränkt). By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part, please stop using the Services immediately.

1. Service Availability and Quality
1.1 Service Modifications
We, Tuari AI UG (haftungsbeschränkt), continuously improve the Services and may add, remove, or modify features without prior notice. The Services are provided on a commercially reasonable basis; we do not warrant that they will be error-free, uninterrupted, or meet your specific requirements.
1.2 Dependency Disclaimer
Do not rely on the Services for any critical purpose. We are not liable for loss or damage arising from such reliance.
1.3 Usage Restrictions
You agree not to:
- Reverse-engineer or attempt to extract the source code.
- Use automated systems or software to access the Services outside documented APIs.
- Resell, redistribute, or sublicense the Services.
- Use the Services to develop or offer competing products.
1.4 Scheduled Maintenance & Downtime
We may suspend or throttle the Services, in whole or in part, to perform maintenance, implement new features, or address unanticipated technical, security, or legal issues ("Downtime"). Downtime may also result from outages at cloud-infrastructure providers, upstream model hosts, or other force-majeure events. We will use commercially reasonable efforts to post advance notice on our status page or by e-mail, but are under no obligation to do so. Downtime does not pause your billing cycle and does not constitute a breach of these Terms. Your sole and exclusive remedy for Downtime is, at oursole discretion, either (a) a pro-rata extension of your current subscription not exceeding two (2) days per monthly cycle, or (b) issuance of an equivalent service credit; we have no obligation to provide cash refunds.
2. Eligibility and Account Security
2.1 Age Requirements
By using the Services you confirm that you are at least 13 years old (or a higher minimum age required in your country). If you are under the age of majority, your parent or legal guardian must accept these Terms on your behalf.
2.2 Account Responsibility
You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorised use or security breach.
3. Subscription Plans and Billing
3.1 Subscription Tiers
Tuari AI UG (haftungsbeschränkt) offers several subscription plans (e.g. Basic, Standard, Pro) with different features and credit allowances. See our Subscription Plans Page for details.
3.2 Billing Cycle
Subscriptions are billed at the start of each cycle (monthly or annually) and charges are deducted automatically from your saved payment method.
3.3 Upgrade and Downgrade Policy
Upgrades. We charge the price difference between your current plan and the higher-tier plan immediately. You then receive the full credit allowance of the higher plan as if you had begun the cycle on that plan; any credits already consumed simply count against the new, larger allowance. Downgrades. Not supported – cancel at period-end and subscribe to a lower plan.
3.4 Price Changes
We may change prices with at least 30 days' notice. Continued use after the change constitutes acceptance.
4. Credits and Usage
4.1 Credit System
Each plan grants a fixed number of credits per billing cycle. Credits refresh at the start of each cycle and, unless expressly stated, do not roll over.
4.2 Credit Consumption
- Image generation – one credit per image.
- Upscaling / variations – one credit per action.
- 3D asset generation – three credits per model.
4.3 API Rate-Limit
To maintain platform stability we may impose or adjust rate-limits. Excess or abusive traffic may result in throttling or temporary suspension of your API key or account.
5. Payment and Charges
5.1 Accepted Payment Methods
We accept major credit and debit cards through our payment provider.
5.2 Immediate Charges
Charges for upgrades or add-ons are applied immediately.
5.3 Invoices and Billing History
Invoices are available in your dashboard and include charge details and dates.
6. Cancellation and Refunds
6.1 Cancellation Policy
You may cancel at any time; paid features remain available until the end of the current billing period.
6.2 Effect on Credits
Unused credits expire at cancellation and are non-refundable.
6.3 Refund Policy
All payments are non-refundable except in cases of billing error.
7. User Responsibilities and Conduct
7.1 Compliance with Laws
You agree to use the Services in compliance with all applicable laws.
7.2 Prohibited Content
You must not use the Services to create or share:
- Illegal, harassing, hateful, or extremist content.
- Sexual content involving minors or exploitative situations.
- Defamatory depictions of real persons.
- Content that violates privacy or IP rights.
- Any military, surveillance or biometric-processing application.
- Political persuasion or lobbying.
- Using Outputs in a way that misleads others to believe they are wholly human-generated.
- Any use disallowed under the CreativeML Open RAIL-M licence (see § 14.2). You must clearly disclose when Outputs are AI-generated whenever required by law, platform rules or reasonable consumer expectations.
7.3 Moderation & Takedown
We may review, block, or remove content and suspend accounts that violate these Terms or applicable law. To request removal of infringing or unlawful content, e-mail contact@aipixls.com. We will respond in accordance with the DMCA and the EU Digital Services Act where applicable.
8. Content Ownership and Rights
8.1 User-Generated Content
Subject to third-party rights and § 14, you own all rights in images you generate.
8.2 Licence Grant to Us
You grant Tuari AI UG (haftungsbeschränkt) a non-exclusive, worldwide, royalty-free licence to host and display your content solely to operate and improve the Services.
8.3 Commercial Use
You may use generated images commercially, provided you comply with all applicable licences and laws.
9. Image Storage and Availability
9.1 Temporary Storage
Generated images are stored temporarily and may be deleted at any time.
9.2 User Responsibility
Download any images you wish to keep; we are not liable for deletions.
10. Limitation of Liability
10.1 Service Interruptions
We do not guarantee uninterrupted availability and are not liable for outages.
10.2 Maximum Liability
Our aggregate liability is limited to the subscription fee paid for the current billing period. This limitation of liability does not apply in cases of willful misconduct, gross negligence, or damages to life, body, or health.
10.3 Disclaimer of Warranties
The Services are provided "as is" without warranties of any kind, to the extent permitted by applicable law.
10.4 Bias & Accuracy Disclaimer
AI models can produce inaccurate or biased results. You should not rely on generated content as a sole source of truth. We disclaim all liability for decisions made on the basis of generated content.
11. Modifications to Terms
11.1 Right to Modify
Tuari AI UG (haftungsbeschränkt) may modify these Terms at any time. We will give notice via email or in-product message.
11.2 Acceptance of Changes
Continued use after changes take effect constitutes acceptance.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
12.2 Jurisdiction
All disputes shall be subject to the exclusive jurisdiction of the courts of Germany.
12.3 Dispute Resolution
We strive to resolve disputes amicably; failing that, the German courts shall decide.
13. Miscellaneous
13.1 Severability
If any provision is held invalid, the remaining provisions remain in effect ("Salvatorische Klausel").
13.2 Entire Agreement
These Terms constitute the entire agreement between you and Tuari AI UG (haftungsbeschränkt) regarding the use of the Services.

14. Third-Party Model Licences and Additional Usage Rules
14.1 Open-Source Model Software
Generation and enhancement run on open-source software hosted by Replicate. These licences govern only the server-side code and do not affect ownership of your images.
14.2 Model Weights — CreativeML Open RAIL-M
Diffusion model weights (Stable Diffusion 2.x, SDXL, etc.) are released under CreativeML Open RAIL-M. You must follow its usage restrictions.

14.4 Black Forest Labs (FLUX Kontext)
Certain image‑generation features are processed by Black Forest Labs Inc.’s FLUX Kontext models (the "BFL Service"). By using those features you also agree to the BFL Terms of Service, API Service Terms and Usage Policy (collectively, the "BFL Terms").
- You may not use the BFL Service for military, surveillance or biometric‑processing purposes; political persuasion or lobbying; generating or distributing content that misleads others into believing it is wholly human‑generated; or for any other activity forbidden by the BFL Terms.
- End users may access the BFL Service solely through our application; you must not expose a public endpoint or disclose any BFL or Replicate API keys.
- By submitting prompts, images or other data to a FLUX feature you grant BFL a worldwide, perpetual licence to use both Inputs and Outputs to operate, train and improve its models.
- If these Terms conflict with the BFL Terms, the BFL Terms control for BFL‑powered features.
15. German Consumer Information
15.1 Widerrufsrecht (Right of Withdrawal)
If you are a consumer (Verbraucher) under § 13 BGB, you have a statutory 14-day right of withdrawal when purchasing digital content. Because you gain immediate access to the Services upon purchase, you expressly request that we begin performance and acknowledge that you lose the right of withdrawal once performance has begun (§ 356 Abs. 5 BGB).
15.2 Verbraucherstreitbeilegung
We do not participate in consumer dispute-resolution proceedings under the Verbraucherstreitbeilegungsgesetz and are not obliged to do so.
16. Language of the Agreement
These Terms are available in both English and German. In case of any discrepancy between the language versions, the German version shall prevail.
